Our work in Davis v. Dow Chemical Corp. resulted in a change of law that corrected a fundamental unfairness in Arizona law. Previously, families had just one year after a relative’s death to file a wrongful death suit – meaning that if they first learned of the negligence after that year passed, they were out of luck. On appeal in Davis, the U.S. Court of Appeals of the 9th Circuit corrected that injustice, ruling that the statute of limitations would start to toll only after families learned that they might have a case.
