California Workers' Compensation

When a worker is injured or killed on the job, or becomes disabled (permanently or temporarily) or ill due to the circumstances of his or her work, workers' compensation provides much needed financial support.  In California, like other states, it is insurance that employers are required by law to carry.   While workers' compensation statutes vary from one jurisdiction to another, they generally cover medical care expenses, including:

  • Medical, surgical, and hospital services
  • Dental services
  • Crutches, hearing aids, and prescribed medications
  • Chiropractic treatment and physical therapy
  • Nursing care

Medical treatment – at the employer's expense – typically continues for as long as it is necessary and reasonable.  Additional financial compensation may be provided if an injured employee is unable to work for more than a certain number of calendar days, as specified by state law, or is hospitalized or becomes permanently disabled.  When a worker is killed on the job, benefits are generally payable to his or her dependents – in which case, workers' compensation acts as life insurance.

Yet as clear-cut as workers' compensation may sound, assuring that its benefits flow to those who need, and warrant, them is often a complex matter.  Incidents need to be investigated, laws and regulations understood and enforced, recalcitrant employers urged – sometimes forcefully in a courtroom – to do the right thing.  Protecting the rights, and the recovery, of injured workers often requires the assistance of a law firm experienced, and successful, in handling these cases.
